Welcome To Market Haven. 

By registering as a user, providing content, and posting products through the listings available on the Market Haven platform, you agree to be bound by these Terms and Conditions and our Privacy Policy. In these terms and conditions, “we”, “us”, “our” and Market Haven refer to Market Haven, and “you” and “your” refer to you, the Market Haven user.

The following terms and conditions apply to your use of the platform. This includes mobile and tablet versions, as well as any other version of Market Haven accessible via desktop, mobile, tablet, social media, or other devices.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING, POSTING INFORMATION ON, OR OBTAINING ANY SERVICES OR PRODUCTS FROM THE PLATFORM.

1. ACCEPTANCE OF TERMS

This agreement sets forth legally binding terms for your use of Market Haven. By registering and using the platform, you agree to be bound by this agreement. If you do not accept the terms of this agreement, you should not use the platform and discontinue the use of the service immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on the website. You agree to be bound by any modification to these terms and conditions when you use Market Haven after any such modification is posted; it is, therefore, important that you review this Agreement regularly.

You represent and warrant that all registration information you submit is accurate and truthful; and that your use of the platform does not violate any applicable law or regulation. Market Haven may, in its sole discretion, refuse to offer the services to any user and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the service and the platform is revoked in such jurisdictions.

The platform may only be used in compliance with these terms and all applicable local, state, national, and international laws, rules, and regulations.

By registering and using the platform, you represent and warrant that you have the full right, power, and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into this agreement.

2. VENDOR/SELLERS
2.1. Registration

If you wish to become a user, you must read this agreement and indicate your acceptance during the registration process in order to be able to publish and offer products through the listings available on Market Haven and receive orders from buyers through the website.

In consideration of your use of the platform as a user, you represent that you are of legal age to form a binding contract under any applicable jurisdiction. You also agree to (a) provide true, accurate, current, and complete information about yourself and your product as prompted by the registration form available on Market Haven and (b) maintain and promptly update your registration data to keep it true, accurate, current, and complete (c) possess the commercial rights or licenses to publish the products on the website. If we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, Market Haven reserves the right to suspend or terminate your account, remove your products from the website and refuse any and all current or future use of the service (or any part thereof) at any time and without notice if Market Haven believes that you have violated any provision of these terms and conditions.

You represent and warrant that the products you publish through the listings available on the website comply with all applicable regulations in force.

Users may share personal and commercial information through the website with other users. Any information that users share through the website is the sole responsibility of the users themselves. Users are free to share information but are responsible for the use of such information, its publication, and its disclosure. Market Haven is not responsible for the information posted and shared through the website. The information you provide and publish through the website will be visible to the general public.

2.2. Account

If you register on Market Haven, you will be required to choose a password, and you may be asked for additional information regarding your account. You are responsible for maintaining the confidentiality of your password and account information and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Market Haven of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you log out from your account at the end of each session. You may never use another User’s account without prior authorization from Market Haven. Market Haven will not be liable for any loss or damage arising from your failure to comply with this agreement.

By providing Market Haven with your email address and phone number you consent to our use of your email address to send you notices about the service and products. We may also use your email address and phone number to send you notifications, push notifications, and other messages, such as changes to service features, news, and special content. If you do not wish to receive these emails, you may opt out of receiving them by sending us your withdrawal request via the contact information or by using the “unsubscribe” option in the emails or mobile notifications. Opting out may prevent you from receiving emails about updates, news, or special content.

Users may cancel their accounts at any time and for any reason by following the instructions on the platform or by sending us their request through our contact information. That termination will only result in the deletion of the account and the deletion of all the personal data granted to Market Haven.

Market Haven reserves the right to terminate your account or your access immediately, with or without notice to you, and without liability to you, if Market Haven believes that you have breached any of these terms, furnished Market Haven with false or misleading information, or interfered with the use of the platform or the service by others.

2.3. Subscriptions

Market Haven’s services are available through monthly plans. Market Haven offers the following monthly plans:

  • Single Showcase Bundle: $5 per month
  • Business Starter: $25 per month
  • Growth Bundle: $100 per month
  • Ultimate Suite: $150 per month

Sellers will be able to publish and offer their products through the platform and reach a wider audience. Various features will also be associated with subscriptions. When a user places an order for a subscription, the user agrees and declares to purchase the subscription for the price advertised on the website. Please check the price and features of the subscription before ordering.

When a user places an order, Market Haven will send a confirmation email. This confirmation email will be produced automatically so that the user has confirmation of the payment and the start of the subscription. If the user does not receive the email, it may have been sent to their spam folder.

Market Haven may change or discontinue the availability of subscriptions at any time at its sole discretion. If a subscription is canceled, any payment made for the subscription will be refunded. This does not affect your statutory rights.

Subscriptions may include automatic recurring payments. You authorize Market Haven to renew your subscription and to charge you on a periodic and progressive basis. The subscription billing date is the date you make your first payment. The subscription billing date will be automatically debited from your account if applicable  with all  fees for the next subscription period. The subscription will continue until you cancel it or we terminate it. You must cancel your subscription before it renews to avoid the next billing period. .

Subscriptions can or will automatically renew for an additional period unless canceled prior to the next payment. If the user wishes to reactivate the subscription, a new subscription must be purchased.

2.4 Paid Services

Certain of our Services may be subject to payments now, in the future, or recurring (the “Paid Services”). Please note that any payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of this Agreement.

2.5. Orders

The user reserves the right to determine the price of the products and may change the price at its discretion. The user may choose whether or not to charge VAT on the products. The price of the product and its different variants will be available on the page or listing of each product. We allow 2-3 days for product order processing. The user may choose whether to offer in-store pickup, free shipping, or to charge shipping costs. The shipping costs will be determined by the user.

When Market Haven receives an order or any request related to the products published and offered on the platform by the users, Market Haven will immediately send the corresponding information to the user to attend to this order or request. Market Haven is committed and obliged to send the specific orders to the corresponding seller and not to other sellers. The orders and requests received through the platform are the sole and exclusive responsibility of the users. Users shall be obliged to respond to and fulfill orders that are transmitted through the platform. Vendors are responsible for fulfilling orders promptly and accurately, and providing buyers with tracking information when applicable. Vendors must comply with all applicable laws and regulations related to shipping and delivery, including those related to packaging and labeling.

2.6. Payments

Subscriptions will be paid through cash on delivery, direct bank transfer, and Fygaro payment gateway (payment platforms available on Market Haven). Subscriptions will be activated once the payment process is completed. Payment will be charged to your bank account or Fygaro balance immediately after the subscription purchase process. Once the transaction has been processed, we will send you an electronic receipt of the transaction to the email address you provide. Subscription prices will be available for the first year of the subscription. Prices may be subject to change after 1 year.

If you find any inconsistencies in your billing, please contact us through our contact details or you can make the claim through the customer service of the relevant payment platform.

If your payment is declined, you will receive an error message. No payment will be charged to your account and no order will be processed. There may be a pending transaction on your account until your bank withdraws the authorization. This usually takes 2 to 5 business days. Your payment may be declined for a number of reasons, such as insufficient funds, AVS (Address Verification System) mismatch, or you have entered incorrect details.

If your payment is declined, you will need to provide an alternative payment method or provide another account on which the payment can be charged and processed.

Your payment details will be processed and protected in a secure manner and for the sole purpose of processing the payment of subscriptions and transactions within the platform. Market Haven reserves the right to engage any payment platform available on the market, which processes your data for the sole purpose of processing the payment of subscriptions and transactions within the platform. Subscriptions are done monthly.

2.7. Prohibited Items

Registered sellers shall be prohibited from posting the following products or goods:

  1. Asbestos
  2. Live animals
  3. Military weapons and ammunition and controlled equipment (e.g., archery, sporting weapons, hunting equipment, replica weapons)
  4. Adult content, pornography, and sex-related products or services (e.g., live porn, sex chat)
  5. Crypto-currencies, bitcoin, e-wallets and prepaid credit cards, and related products and services
  6. Money, paper money, or any other bearer security
  7. Invasive medical devices or equipment for invasive beauty treatments (e.g., Botox, peeling, hyaluronic acid)
  8. Drugs or any type of illegal substances, including products simulating the effects of any illegal drug; as well as any substance for the manufacture of drugs and any equipment used to produce, combine, convert, process, prepare, conceal and consume illegal drugs
  9. Forex, binary options, stock exchange and/or investment programs or courses (e.g., assets, stocks, shares) and future investments
  10. Biological material of human origin (e.g., hormones, human hair)
  11. Radioactive material
  12. Corrosive and explosive materials, compressed gases and aerosols, flammable liquids, oxidizing materials, flammable solids
  13. Drugs (whether sold by prescription or not) or any substance related to the miraculous cure of any disease or health condition, including any hospital equipment
  14. Precious metals, jewelry or any other product made from these materials
  15. Illegal living plant species; straw and fodder
  16. Products or services for enlargement of body parts (e.g., penis and breast enlargement)
  17. Products prohibited by the local Public Health Agency, Health Authority or equivalent
  18. Products that damage trademarks, patents, copyrights, and other intellectual property rights (e.g., counterfeit products)
  19. Products related to pedophilia, child pornography, child nudity, as well as articles in any form involving the illegal participation of minors
  20. Products that are stolen, misappropriated in any way, smuggled, counterfeit, adulterated, or replicated
  21. Mobile phone recharging and unlocking of mobile phones
  22. Controlled substances and/or other products that present risks to consumer safety
  23. Gift cards
  24. Invasive cosmetic treatments (e.g., Botox, peels, hyaluronic acid)
  25. Poisons: liquid, solid, or gas
  26. Any other product, service, or activity that is considered illegal in any jurisdiction.
2.8. Creating and Managing your Listing

For Market Haven, your listing must include complete and accurate information about your product or property, its features, specifications, and any special requirements that apply to the product. Based on the plan you select, Market Haven will handle the information about your product or property, its features, and specifications, but you are responsible for setting and managing the price of your products. It is essential to keep the information and content of your listing (such as photos) up to date and accurate at all times.

2.9. Ratings and Reviews

At Market Haven, buyers have the opportunity to leave comments (“Reviews”) and rate products using a 1-5 star rating system (“Rating”). These Reviews and Ratings should reflect the buyer’s honest experience with the seller’s products.

As a seller, you acknowledge that your product’s Rating and Review will be publicly available for viewing on the Market Haven platform.

While we do not routinely monitor or edit Reviews or Ratings, we may conduct periodic checks of posted content. If we encounter any Reviews that we deem to be illegal, defamatory, offensive, or obscene, we reserve the right to promptly remove such content without prior notice.

Any reported Reviews that are alleged to be illegal, defamatory, offensive, or obscene will be thoroughly investigated. We will take appropriate action as necessary in response to such reports.

By using the Market Haven platform, you agree to indemnify and hold us, along with our affiliates and their respective employees, directors, and representatives, harmless against any claims or actions brought by third parties arising from or related to any Reviews or Ratings left by buyers on the platform.

3. THIRD-PARTY MATERIALS

“Third-Party Materials” at Market Haven refer to any content, images, videos, texts, or other materials owned by third parties, such as stock images, videos, and texts. These Third-Party Materials are subject to the terms and licenses provided by the respective third parties, and they may only be used in accordance with those terms and licenses.

4. LICENSE TO USE THE PLATFORM

Market Haven grants you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the platform provided to you by Market Haven as part of the services. This license is solely for enabling you to use and benefit from the services as provided by Market Haven, in accordance with these terms. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless prohibited by law or you have obtained our written permission.

As a user, you agree not to use the platform and its services negligently, for fraudulent purposes, or in any unlawful manner. You also agree not to engage in any conduct or action that could harm the reputation, interests, or rights of the Market Haven platform or third parties.

The platform prohibits the sending of messages that:

  1. Are categorized as SPAM.
  2. Contain harassing, abusive, defamatory, obscene, unethical, or otherwise illegal content.
  3. Distribute trojans, viruses, or other malicious computer software.
  4. Include political or religious content.
  5. Feature obscene or offensive content.
  6. Are intended for fraud, impersonation, phishing, scams, or related crimes.
  7. Distribute intellectual property without ownership or a proper license.
  8. Breach the terms of service, privacy policy, or rules of the platform or the recipients in any way.

Market Haven reserves the right to immediately terminate your access, with or without notice and without liability to you, if we believe that you have violated any of these terms or interfered with the use of the platform or service by others.
